Peter A. Gersten, Esq., of Citizens Against UFO Secrecy (CAUS), filed a
lawsuit against the Department of the Army, in U.S. District Court, at
Phoenix, Arizona on Wednesday March 25th.
The suit requests all documents related to observations made by former
Army Lt. Col. (Ret) Philip J. Corso, as described in his book, The Day
After Roswell. Documents related to the alleged crash of an unrecognized
airborne object in New Mexico, in 1947 near Roswell.

The Department of the Army denies that any records of bodies found at
the alleged site or autopsy reports exist.

My understanding of the complaint is this: Gersten filed a FOIA
request with the Army asking for all its alien autopsy reports and
records. The Army replied that it doesn't have any. Gersten is now
going to court to force the Army to give him the records it says it
doesn't have.
I wonder what the legal precedents are for this.
In court, the Army is likely to say exactly what it told Gersten: "We
can find no documents responsive to that request." Gersten, for his
part, has no evidence that such documents exist, apart from Corso's
book -- which is hearsay -- or Corso's direct testimony, which would
be pretty vague and rambling judging from video tapes of him I have
seen.
So what is the court supposed to do?
This is like FOIAing the Agriculture Dept. for all evidence that Elvis
is still alive. The Agriculture Dept. replies that it has no
documents responsive to that request. Taking them to court is not
going to change their response, even if they are indeed hiding
Elvis somewhere. -- GC
