I anticipate that the government's response to the CAUS v. Army lawsuit
will be a Motion for Summary Judgment to dismiss the lawsuit on the
grounds that there is no 'triable issue.' Pursuant to the Motion, the
government will submit affidavits swearing that they did a thorough search
based upon CAUS' administrative request and could not find any responsive
documents.
In order to create a 'triable issue' to defeat the Motion and move into
the discovery stage of the litigation and hopefully determine whether such
documents ever existed, and if so, what happened to them, CAUS will need
an affidavit from Colonel Philip Corso swearing that certain statements he
made in 'Day After Roswell' and summarized in his affidavit are true. That
affidavit has now been prepared and sent to Colonel Corso for his
signature.
You may access the affidavit at the CAUS website http://www.caus.org.
